01. Acceptance of Terms Binding Contract
By downloading, installing, accessing, or using SMARAN.AI (including the Windows desktop software, Linux build, Android application, VS Code extension, CLI, and website), you agree to be bound by these Terms of Service.
If you do not agree with these Terms, you may not download or operate the software. This software is created, maintained, and released by Shashwat Mishra ("Author", "Developer", "We").
02. License & User IP Ownership Your Work Is Yours
Software License: SMARAN.AI is free to download and use. Its source code is not published at this time. The SMARAN.AI Codex extension for VS Code is released under the MIT License.
Unlike cloud AI corporations, SMARAN.AI claims zero rights, licenses, or ownership over anything you write, prompt, design, generate, or execute using the software. Your work belongs entirely to you.
Neither the Developer nor any affiliate asserts copyright or intellectual property claims over your source code, conversation memories, document embeddings, or generated software artifacts created through SMARAN.AI.
03. Privacy & Offline Use No Telemetry
SMARAN.AI is built on an uncompromising principle of user sovereignty:
- No Prompt Telemetry: Your prompts, chat logs, voice transcripts, and local vector embeddings are never sent to the Author. They go to a third party only when you choose to: a cloud AI provider whose key you add, web search when it is on, a bot you connect, or a reply in a language other than English that you have read aloud (Microsoft's voice service); during a Gemini voice call, your microphone audio (and screen or camera, if you turn them on) goes to Google; and prompts made in the Cloud tab of Images or Video go to the provider shown there (NVIDIA, Pollinations or Hugging Face). The app sends no usage counts or reports of any kind to the Author.
- Local File Persistence: All databases, documents, and chat records reside strictly in your local user directory on your personal machine.
- Offline Capability: With local models downloaded, chat works without an internet connection. Web search, cloud models, updates and bots need one.
04. Acceptable Use Policy Responsible Computing
When operating SMARAN.AI, you agree to:
- Comply with all applicable local, national, and international laws and regulations.
- Refrain from using the tool to generate malware, automated cyber-attacks, unlawful surveillance software, or sexually explicit content involving minors.
- Comply with the specific community license agreements of any open-weight AI model downloaded through or paired with the app (such as Meta's Llama Community License or Qwen Community License).
05. AI Output Disclaimers & Hallucinations Probabilistic Generation
Artificial intelligence models generate probabilistic predictions and may generate inaccurate, incomplete, or hallucinated responses:
- No Professional Advice: Code, medical, financial, or legal insights generated by SMARAN.AI do not constitute professional advice.
- Independent Verification Required: You are solely responsible for reviewing, testing, linting, and verifying any code, script, or system modification prior to running it in production or production-like environments.
06. Limitation of Liability & Disclaimer of Warranties AS-IS
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
IN NO EVENT SHALL THE AUTHOR, DEVELOPER, OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, LOSS OF DATA, HARDWARE MALFUNCTION, THERMAL DAMAGE, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
07. Third-Party Model Weights & Cloud Connectors Integrations
SMARAN.AI supports both local offline models (GGUF, Ollama) and optional cloud AI providers (Google Gemini, Groq, OpenRouter). If you choose to configure external API keys:
- Your interactions with cloud providers are governed directly by their respective Terms of Service and Privacy Policies.
- SMARAN.AI does not proxy, store, or intercept your third-party API keys on any remote server.

These Terms may be updated from time to time to reflect new features, capabilities, or statutory requirements. Continued use of the software after any modification constitutes your acceptance of the updated terms.
